§ 1

Subject of the regulations

  1. The regulations apply to all individuals staying at Casa de Flamingos in El Mojon, Spain.
  2. The regulations define the rules for providing services, the scope of responsibility for guests and the homeowners, and the rules for staying on the premises of the hotel.
  3. The regulations are available at the property and on the hotel’s website www.casadeflamingos.com
  4. Confirmation of familiarity with the regulations occurs at the time of making a reservation, paying a deposit, paying the full amount for the stay, or signing the registration card.

§ 2

The reservation and cancellation policy

  1. To make a reservation, an advance payment of 30% of the total amount is required within 3 days of making the preliminary reservation through the booking system – to the following bank account in EURO: Radosław Krzysztof Jaśkiewicz IBAN PL56249010570000990289526843
  2. All payments for the stay are made exclusively in EURO currency.
  3. The remaining amount for the entire rental period must be paid in full no later than 10 days before arrival to Casa de Flamingos to the provided bank account.
  4. In the event of non-payment, the reservation and advance payment will be forfeited.
  5. The tenant is obliged to pay a cash deposit of 100 EURO on the day of check-in.
  6. The deposit will be refunded promptly after the rental period ends and the condition of the apartment is checked, either in cash or to the tenant’s bank account, within 3 business days if an immediate inspection of defects is not possible.
  7. If significant damage is found in the apartment by the caretaker, the deposit refund will be withheld until the repair/replacement of equipment. If repair/replacement costs exceed the deposit amount, the tenant agrees to cover the remaining costs (based on receipts and invoices).
  8. The post-stay cleaning fee is 130 EURO. Payment can be made when transferring to the bank account or to the housekeeper at the end of the stay.
  9. The lessor reserves the right to cancel the reservation in case of force majeure (e.g., flooding, damage caused by the previous tenants preventing the stay). In such a situation, the lessor will promptly return the entire amount paid so far, and the tenant will not seek claims for the return of double advance payment.
  10. The tenant can cancel the reservation at any time. In case of cancellation:
    • Up to 30 days before the arrival date – the advance payment is refunded, and the reservation is canceled.
    • From the 29th day before the arrival date – The lessor will charge the guest a fee of 30 percent of the reservation value (loss of the advance payment).
    • From the 19th day before the arrival date – The lessor will charge the guest a fee of 50 percent of the reservation value (loss of the advance payment).
    • From the 14th day before the arrival date – The lessor will charge the guest the full amount of the reservation value.
  11. Conditions for long-term stays may be individually negotiated based on separate agreements/contracts.

§ 3

House Rules for Casa de Flamingos

  1. The apartment is rented on a daily, weekly, or monthly basis. A minimum of 4 days is required, unless otherwise agreed by the Parties.
  2. The stay period is from 4:00 PM to 11:00 AM the following day unless other arrangements are made. Different check-in/check-out times may be arranged directly with the Apartment Caretaker, provided it does not disrupt ongoing stays or subsequent guest check-ins.
  3. It is assumed that the room is rented for 1 day unless the guest specifies otherwise.
  4. Casa de Flamingos will consider extending the stay based on availability.
  5. The release of the apartment is made by presenting proof of identity to the Apartment Caretaker, handing over the house keys, and familiarizing the Tenant with its facilities.
  6. The house caretaker may refuse to issue keys to individuals under the influence of alcohol, drugs, or behaving aggressively, posing a threat to people or property, as well as if there is a possibility of violating the provisions of the Rules.
  7. There is a nighttime silence policy in the apartment from 10:00 PM to 6:00 AM. Therefore, persons present in the premises during these hours should not disturb the peace of other residents. In the event of noise or disturbances, neighbors may contact the police, which may result in a fine.
  8. The tenant of the apartment cannot sublet it to third parties or provide it for free use, even if the paid rental period has not expired.
  9. Dangerous materials such as weapons, ammunition, flammable, explosive, or irritating substances are not allowed to be stored in the room.
  10. Please consult the house caretaker for any changes to the room setup.
  11. Guests are prohibited from removing any property that constitutes the house’s equipment beyond the Casa de Flamingos premises.
  12. Unregistered persons can visit the room between 7:00 AM and 10:00 PM.

§ 4

Responsibility of Guests

  1. Children under the age of 12 should be supervised by their legal guardians while staying at Casa de Flamingos. Legal guardians are financially liable for damages caused by children.
  2. Casa de Flamingos is pet-friendly. Pets should be registered in advance.
  3. All damages to Casa de Flamingos’ property or the property of other guests caused by pets will be assessed by the homeowner, and the costs will be charged to the pet owners.
  4. Failure to inform the home caretaker about the presence of a pet in the room will result in a fee of 300 euros.
  5. Smoking cigarettes, marijuana, or using candles is strictly prohibited throughout the entire Casa de Flamingos property, including balconies and room terraces. Smoking inside the property will incur a charge of 200 euros for the registered guest, covering room cleaning, ventilation, additional laundry, and equipment cleaning.
  6. For fire safety reasons, using portable heaters and other portable heating devices and electrical appliances not provided by the apartment is prohibited. This does not apply to chargers and power supplies for electronic and computer devices. The tenant bears full responsibility for any breaches of fire safety regulations.
  7. For safety purposes, before leaving the apartment, the tenant must turn off all electrical appliances (boiler, air conditioning, electric stove, heaters, washing machine, etc.).
  8. The tenant must double-lock the apartment’s entrance door every time they leave the premises and close the balcony doors and all windows.
  9. Maintaining cleanliness and cleaning inside the apartment during the entire stay is the responsibility of the tenant. It is prohibited to dispose of hygiene products such as sanitary pads, tampons, and paper towels into the toilet.
  10. Removing apartment furnishings, blankets, bathroom towels, or kitchen utensils is prohibited. Only beach equipment (beach towel, beach towels, parasol, and beach chairs) may be taken out.
  11. Before vacating the apartment, in the tenant’s presence, the caretaker has the right to inspect the technical condition of the apartment, its equipment, and appliances, and the tenant must return the full set of keys.
  12. The tenant must immediately report any damages caused by them during their stay. The tenant also bears full responsibility for damages caused by individuals staying with their consent or knowledge in the apartment.
  13. The tenant is financially responsible for any damages or shortages of items, equipment, and technical devices caused by the tenant or their visitors. Damages will be settled against the security deposit. If the repair costs exceed the security deposit, the tenant must cover the difference.
  14. Guest behavior should not disturb the peace of other guests and residents of the neighborhood where Casa de Flamingos is located.
  15. Air conditioning should only be used with closed doors and windows.

§ 5

Casa de Flamingos’ Responsibility

  1. In cases related to the loss or damage of items brought in by guests, the provisions of the Civil Code apply.
  2. Casa de Flamingos is not liable for damages or loss of the guest’s car or any other vehicle parked in an unguarded parking area. Casa de Flamingos is also not responsible for items left in the guest’s car parked on the premises.

§ 6

Left Items

  1. Items left at Casa de Flamingos will be returned at the expense of the guest and to the address indicated by the guest.
  2. In the absence of instructions, Casa de Flamingos will store the left items for one month, after which they will be donated to charity or for public use. Perishable items will be kept for 24 hours.

§ 7

Complaints

  1. Guests have the right to file complaints if they notice any shortcomings in the quality of the services provided. The complaint should be submitted immediately after noticing the shortcomings.
  2. The caretaker of the house accepts all complaints in written form.
  3. The complaint will be considered promptly upon receipt by Casa de Flamingos, and in case of disputes, civil law regulations will apply.

§ 8

Final Provisions

  2. In the garden, in front of the house entrance, two cameras are installed. The purpose of using video surveillance is to protect the safety of guests and other individuals on the premises of Casa de Flamingos or in its vicinity.
  3. The tenant declares that they have read and accepted the terms of the Lease Agreement and the regulations for using the apartment, committing to comply with them.
  4. In case of non-compliance with the conditions specified in §2 by the tenant, the landlord has the right to terminate the agreement without refunding the previously paid amount.
  5. The number of people staying in the apartment is limited to the number reported during the booking process. If the number of people exceeds the number provided at the time of booking, the landlord may demand an additional fee or require immediate departure from the apartment.
  6. For matters not regulated in this agreement, the provisions of the Civil Code apply. All disputes will be settled in the District Court of the Lessor.

§ 9
GDPR

In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), we would like to inform you about the following principles of personal data processing:

  1. The administrators of your personal data are Aneta Duda-Jaśkiewicz and Radosław Jaśkiewicz, hereinafter referred to as the ‘Administrator’. Contact details: kontakt@casadeflamingos.com.
  2. Personal data provided by guests is collected and processed by the Administrator for the purpose of executing the agreement or actions in the booking/complaint process, as well as for sending marketing information.
  3. The legal basis for the processing of personal data is Article 6(1)(b), (c), (f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
  4. The Administrator and entities providing services to the Administrator, e.g., technical support, IT services, accounting services, will have access to your data.
  5. Your personal data will be processed by the Administrator for a period necessary to achieve the purpose of personal data processing, taking into account limitation periods for potential claims arising from the agreement, as well as legal obligations incumbent on the Administrator.
  6. You have the right to access processed personal data, to rectify, erase, restrict processing, object to processing, and the right to data portability, subject to the limitation that the right to data portability applies only to data processed in an exclusively automated manner.
  7. You have the right to lodge a complaint with the President of the Personal Data Protection Office.
  8. Providing personal data is voluntary. Failure to provide personal data may result in the inability to achieve the purpose of data processing.
